Welcome to bagsinleather.com (“Site”), operated by Bags In Leather (“we,” “us,” or “our”), a business located in Tetouan, Morocco. These Terms of Service (“Terms”) govern your use of our website and your purchase of products from us.

By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Site or purchase our products.

We reserve the right to update these Terms at any time. Changes take effect immediately upon posting. Your continued use of the Site after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years old to use this Site or place an order. By using this Site, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

If you are under 18, you may only use this Site with the involvement and consent of a parent or guardian.

3. Products & Descriptions

We make every effort to display our products as accurately as possible. However, because every bag is handcrafted from natural full-grain leather, slight variations in color, texture, and grain pattern are normal and expected. These variations are a hallmark of genuine handmade leather goods and are not considered defects.

Colors may also appear differently depending on your screen settings and monitor calibration. We do not guarantee that your screen’s display of any color will be exactly accurate.

We reserve the right to modify, discontinue, or update product descriptions, pricing, and availability at any time without prior notice.

4. Pricing & Payment

All prices on our Site are listed in US dollars (USD) unless otherwise stated. Prices are subject to change without notice.

We accept payment via major credit cards, debit cards, and PayPal. All payments are processed securely through PCI-DSS compliant third-party payment processors. We do not store your full credit card information on our servers.

By placing an order, you represent that the payment information you provide is accurate and that you are authorized to use the payment method.

In the unlikely event that a product is listed at an incorrect price due to a technical error, we reserve the right to cancel the order and issue a full refund. We will notify you promptly if this occurs.

5. Orders & Acceptance

Placing an order on our Site constitutes an offer to purchase. All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

You will receive an order confirmation email after placing your order. This confirmation does not constitute acceptance — it simply acknowledges that we have received your order. Acceptance occurs when we ship your product and send you a shipping confirmation email.

We reserve the right to limit the quantity of items purchased per person, per household, or per order.

6. Shipping & Delivery

We ship from our workshop in Morocco to the United States, United Kingdom, Canada, and Australia via DHL Express and FedEx. Orders are processed within 3–5 business days.

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, weather, or other circumstances beyond our control.

Risk of loss and title for items purchased from us pass to you upon delivery of the items to the carrier.

7. Customs, Duties & Taxes

International orders may be subject to import duties, taxes, and customs fees imposed by the destination country. As the buyer, you are the “Importer of Record” and are responsible for all such charges.

These fees are not included in our product prices or shipping costs. We recommend contacting your local customs office for an estimate before placing an order.

8. Returns & Refunds

We offer a 30-day return policy from the date of delivery. Items must be unused, in original condition, and returned with all original packaging, dust bag, and tags.

Personalized or custom-made items and items marked as Final Sale are not eligible for return.

Return shipping costs are the responsibility of the customer unless you purchased Package Protection at checkout. Original shipping charges are non-refundable.

Refunds are issued to your original payment method within 5–7 business days of receiving and inspecting the returned item. Please allow an additional 5–10 business days for the refund to appear on your statement.

9. Warranty

All Bags In Leather products are covered by our Lifetime Craftsmanship Guarantee. We guarantee our workmanship and materials for the lifetime of normal use. This warranty covers manufacturing defects in stitching, hardware, structural integrity, and leather at seam points.

The warranty does not cover normal wear and tear, natural leather aging (patina), accidental damage, water damage, improper care, unauthorized modifications, misuse, or loss and theft.

10. Intellectual Property

All content on this Site — including text, images, photographs, product descriptions, logos, graphics, page layout, and design — is the property of Bags In Leather and is protected by international copyright, trademark, and intellectual property laws.

You may not copy, reproduce, distribute, modify, display, or create derivative works from any content on this Site without our prior written consent.

The “Bags In Leather” name, logo, and all related marks are trademarks of Bags In Leather. Unauthorized use of any trademark displayed on this Site is strictly prohibited.

11. User Conduct

By using our Site, you agree not to:

Our total liability to you for any claim arising from your purchase shall not exceed the amount you paid for the specific product in question.

This limitation applies regardless of the legal theory on which the claim is based, including breach of contract, tort (including negligence), strict liability, or any other basis.

14. Disclaimer of Warranties

This Site and its content are provided on an “as is” and “as available” basis. Except for the Lifetime Craftsmanship Guarantee described on our Warranty page, we make no other warranties, express or implied, regarding the Site or our products.

To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, shipping carrier disruptions, supplier failures, or power outages.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Site shall be resolved through good faith negotiation first. If a resolution cannot be reached, the dispute shall be submitted to the competent courts in Tetouan, Morocco.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable. All remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, Shipping & Returns Policy, and Warranty & Guarantee, constitute the entire agreement between you and Bags In Leather regarding your use of the Site and purchase of our products. These Terms supersede any prior agreements or understandings.
